Interim stay on proceedings against Amit Mishra vacated by Karnataka HC

Indian spinner Amit Mishra will now have to appear before the court and make his submissions. Mishra is expected to attend the court trials and give his submissions in relation to the physical assault case against him. The Karnataka High Court has now vacated the interim stay it had imposed on the proceedings against Mishra.

The Karnataka High Court Justice Byrareddy cited that the interim stay was only prolonging the case. As a result of the High Court order, Amit Mishra will make his propositions in his defence at the court in the next hearing. Earlier, in September 2015, charges of physical assault were made against the Indian leg spinner.

A woman had made allegations that the leggie misbehaved with her and even physically assaulted her in a hotel room in Bengaluru. Soon after the allegations were made, Amit Mishra was arrested by the Bengaluru police in the month of October last year. However, he was soon released on bail.

The Indian cricketer had subsequently made a plea to the high court to cease the proceedings in the trial court. The High Court had granted his plea and that gave Mishra an interim relief. It was Anees Ali Khan, who had registered the submission on behalf of the complainant woman. The lady had mentioned that she and Amit knew each other from a long time.

She mentioned that the assault took place in the hotel room in Bengaluru. Mishra was travelling with the Indian team at that time to attend a training camp in the city. The lady admitted that she walked in to Mishra’s room in his absence. But Mishra arrived soon after and both had a verbal feud. It was after the heated argument that things turned sour. The lady claimed that Mishra assaulted her and abused her after the verbal feud.

Amit Mishra was subsequently arrested and booked under the Indian Penal Code (IPC) section 354 which relates to assault or criminal force to woman with intent to outrage her modesty.
