Maxx MD claims MS Dhoni willfully creating alarmist circumstances in HC

Mobile company Maxx Mobilink Pvt Ltd, accused Indian limited-overs captain MS Dhoni who was the brand ambassador for them in the past stated in the Delhi High Court that Dhoni is “willfully” creating “alarmist circumstances”. A top official of the company told the court that they never misused his name to sell or promote a product as per the High Court’s order in 2014.

Dhoni had filed a petition in the court requesting proceedings against Ajjay R Agarwal, Managing Director for not following the High Court’s order from November 17, 2014 directing Maxx Mobilink to “refrain from selling any products” which suggests that the cricketer has endorsed it.

Agarwal filed an affidavit in the HC which said they had not used Dhoni’s image and name after November 17, 2014. His agreement with the company had expired in December 2012. While requesting the court to dismiss the plea from the cricketer seeking initiation of contempt against him Agarwal said, “I say and submit that the company has removed all material from its own websites and from social media websites including Facebook.”

The affidavit filed stated, “However, at this juncture, I say and submit that the petitioner number one (Dhoni) is guilty of willfully misleading this court for the sake of creating alarmist circumstances,”

“I say that in the facts of the case before us, Facebook posts containing the image of petitioner number one (Dhoni) was posted by respondent number two (firm) sometime in the year 2012 which was well outside the active webpage of the Facebook account of the respondent number two; which fact was well within the knowledge of the petitioners (Dhoni and Rhiti Sports) who have deliberately dug up the posts associated with the petitioner number one (Dhoni) herein for the sake of creating the present cause of action…,” it mentioned.

Dhoni’s counsel asked the court time to file a reply and the court has set January 24 as the next date for hearing in the case.
